The âsweeping reevaluationâ of the âanimal questionâ that Kalof and Fitzgerald (2007) saw as beginning in the 1970s was slow to make its presence felt in Australia. It was 2001 before the two main bodies governing animal welfare, the Department of Primary Industries and the RSPCA Australia both completed reviews. The Department of Primary Industries website, which lists the âCode of Practice for the Welfare of Film Animalsâ, released its reviewed legislation in October of that year. The department states that, in relation to legislation regarding the treatment of animals, it is important to refer to state practices due to variations in laws:
State and territory legislation generally makes it an offence to be cruel to animals. The Prevention of Cruelty to Animals Act (NSW 1979) is typical; making it a criminal offence to commit acts of cruelty or aggravated cruelty (as defined, but including killing) to any animal or to be a party to such offences.
Companies and persons using animals in film and television productions are advised to familiarise themselves with the relevant act in each state and territory.
The âCode of Practice for the Welfare of Film Animalsâ lists the general requirements to ensure the well-being of a trained, domestic or wild animal in a film or on a television set in Australia. The guidelines are very similar to those in both the US and the UK: all animals are to be maintained in a clean environment, watered and well fed, and not placed under stress; horse âfalls should not be achieved by trip-wires or pitfallsâ (Department of Primary Industries website). But there are some surprises that would provoke the ire of many an animal activist, including a couple of points pertinent to Bad Boy Bubby:
